A partir da promulgação da Constituição de 1988 o Brasil passou um processo de reterritorialização do poder político que implicou em um acentuado aumento do poder decisório nas municipalidades. Este estuda busca dimensionar o papel destas mudanças em nível local a partir da análise do novo desenho jurídico-institucional que passou a reger o ordenamento do poder nas cidades. Foram deste modo analisadas comparativamente as Leis Orgânicas dos Municípios do Estado do Rio de Janeiro e estudados os padrões de relacionamento entre o Executivo e Legislativo. Visando dimensionar o estágio do desenvolvimento democrático nos Municípios Fluminenses investigaram-se os resultados das noventa e duas eleições municipais para o executivo e o legislativo de 1996, 2000, 2004 e 2008. As conclusões apontaram para a necessidade de compreender os papéis dos poderes locais a partir das instituições que os regulam e exibiram os equívocos das teorias dominantes sobre as interações Executivo-Legislativo em nível local. Por fim o estudo mostrou como o sistema político brasileiro foi capaz de promover uma grande expansão democrática eliminando as formas oligárquicas tradicionais.
After ratification of Brazilian Constitution in 1988, Brazil has changed the power balance and municipality became more powerful. This paper intend to measure the role of these changes through the analysis of the new legal and institutional design which govern rules the cities. It have been comparatively analyzed the Municipal Organic Laws of the State of Rio de Janeiro and studied the patterns of relationship between the executive and legislative branches. In order to scale the stage of democratic development in municipalities, it was investigated the results of ninety-two elections to the municipal executive and legislative branches, 1996, 2000, 2004 and 2008. The findings pointed to the need to understand the roles of local authorities by the regulatory institutions and exhibited the mistakes of the dominant theories about the interactions between Executive and Legislative. Finally, the study showed how the Brazilian political system was able to promote a democratic growth eliminating the traditional oligarchic forms.
