Although not a new debate, the discussion about human rights in Brazil, intensified by the process of struggle against the dictatorial regime and the achievement of civil rights, was established in the guidelines of the government and civil society recently. This has to do, to some extent, with the strengthening of democratic principles, which create a larger space for the dissemination of human rights narrative. Given these practical issues, this study sought to advance on the theoretical debate and on the issue of human rights, in order to suggest a possible solution to both the theoretical debates as to the practical problems, including a dimension of action, involving violation of these rights and adherence to its values. This work covers therefore a way to suggest that accession narratives to the values of human rights, including an ideal of democracy, are intertwined with the struggle to end the violations of these rights. Accepting the joint, provided by Habermas, between human rights and democracy, the proposed route will lead to the biggest issue of this paper, indicate that a pragmatic perspective on human rights can be a possible way for violations of human rights come to be increasingly unacceptable in a context that preach the strengthening of democracy.
Apesar de não ser um debate novo, a discussão sobre os direitos humanos, no Brasil, intensificada pelo processo de lutas contra o regime ditatorial e pela conquista de direitos civis, se estabeleceu nas pautas do governo e da sociedade civil muito recentemente. Isso tem a ver, em alguma medida, com o fortalecimento dos princípios democráticos, os quais criam um maior espaço para a disseminação da narrativa dos direitos humanos. Tendo em vista estas questões de ordem prática, este trabalho pretendeu avançar no debate teórico sobre o tema dos direitos humanos, a fim de sugerir uma saída possível tanto para os embates teóricos quanto para os problemas práticos, abrangendo uma dimensão da ação, que envolvem a violação destes direitos e a adesão a seus valores. Este trabalho percorre, portanto, um caminho que pretende sugerir que as narrativas de adesão aos valores dos direitos humanos, incluídos num ideal de democracia, estão imbricadas com a luta pelo fim das violações destes direitos. Aceitando a articulação, fornecida por Habermas, entre direitos humanos e democracia, o percurso proposto levará à questão maior deste trabalho: indicar que uma perspectiva pragmática sobre os direitos humanos pode ser uma via possível para que violações sobre direitos humanos passem a ser cada vez mais inaceitáveis num contexto que pregue o fortalecimento da democracia.
