No presente trabalho analisa-se o período de pendência dos negócios jurídicos submetidos a condições suspensivas, as quais são cláusulas que subordinam a eficácia de um negócio jurídico a evento futuro e incerto. Dois aspectos deste período serão enfocados neste trabalho: a proteção dos figurantes e as modificações sofridas pelo objeto da prestação. O objetivo do trabalho será apresentar a importância das discussões acerca do assunto, realizando uma abordagem funcional do instituto da condição suspensiva.
The present study analyses the pending period of the condition precedent, which is clause that subordinates the effect of a juridical transaction to a future and uncertain event. Two aspects of this period will be highlighted in this paper: the protection of the contracting parties and the changes undergone by the object of the performance. The study aims to present the importance of the discussions on the subject, by a functional approach of the condition precedent.
