O objetivo desta tese é contribuir para a análise sociológica do Poder Judiciário a partir do estudo das motivações das decisões da Justiça do Trabalho na tentativa de entender o processo de convencimento do magistrado. A Associação Nacional dos Magistrados da Justiça do Trabalho (Anamatra) e as vinte e quatro Amatras filiadas exercem um importante papel na criação de consensos entre os magistrados sobre o direito do trabalho e, portanto, influencia a decisão judicial. Essa atuação é realizada por meio de congressos, palestras, jornadas e eventos, bem como pela edição de livros e revistas, em parceria com as escolas judiciais, editoras, conselhos, outras associações e os próprios tribunais. Além disso, essas associações expandiram a sua atuação para o Poder Legislativo, influenciando o processo de produção de Leis e Emendas Constitucionais. O ativismo também as transformaram em autoras de processos judiciais na defesa de direitos corporativos ou de uma determinada concepção do direito do trabalho. São analisadas nesta tese as decisões do Tribunal Superior do Trabalho e dos cinco Tribunais Regionais considerados de grande porte (2ª, 15ª, 1ª, 3ª e 4ª Regiões), que citam expressamente a Anamatra em sua fundamentação.
The objective of this thesis is to contribute to the sociological analysis of the Judiciary through the study of the motivations of the Labour Court's decisions in trying to understand the process of convincing the magistrate. The National Association of Labour Court Judges (Anamatra) and the twenty-four affiliated Amatras (Associations of Labour Courts Judges) play an important role in building consensus among judges on labour law and thus influence the court s decisions. This action of consensus building is accomplished through conferences, lectures, seminars and events, as well as the publication of books and magazines, in partnership with the judicial schools, publishers, councils, other associations, and the courts themselves. Furthermore, these associations have expanded their operations to the legislative branch, influencing the process of law and the constitutional amendments creation. Activism also turned into authors of lawsuits in defence of corporate rights or a certain conception of labour law. In this thesis the decisions of the Superior Labour Court and the five courts considered large regional (2nd, 15th, 1st, 3rd and 4th Regions) are analysed, which expressly mention the Anamatra in its foundation.
