O presente estudo pretende discutir a elaboração de critérios de racionalidade ao direito penal econômico, tanto para a criação quanto para a aplicação da lei, tomando por base parâmetros de racionalidade do direito, expostos em especial na teoria sistêmica de Luhmann e nas teorias da argumentação de Chaïm Perelman e Robert Alexy. Estabelecido que o direito penal econômico é um ramo do direito penal e se sujeita as suas regras e princípios apesar das particularidades inerentes àquele busca-se demonstrar que eventual fluidez da matéria econômica regulada pelo direito penal não pode descuidar de certos princípios estruturantes, previstos ou não na Constituição Federal, devendo o magistrado visar sempre à correção das normas penais econômicas no caso concreto, de modo que situações semelhantes não recebam tratamento diverso, assegurando-se assim o respeito à segurança jurídica.
The present study intends to discuss the elaboration of rational criteria to economical criminal law, both to creation and application of its legislation, taking as basis rationality yardsticks present in the judicial system, exposed especially in Luhmann's systemic theory, as well as in the theories of argumentation written by Chaïm Perelman and Robert Alexy. Knowing that economical criminal law is part of criminal law, and thus subjected to its rules and legal principles despite all particularities pertained thereto , it is sought here to demonstrate that the fluidity typical of economic affairs regulated by criminal law should not leave out structuring principles, whether or not directly mentioned in the Constitution, being then the judge's task to correct economical criminal law, whenever necessary, whilst applying its rules to concrete cases, so that similar situations will not be treated differently, garanteeing therefore respect to legal security.
