Travestilidade e cárcere: uma análise crítica sobre os mecanismos protetivos aplicáveis às pessoas transgêneros privadas de liberdade no Rio de Janeiro

Essa dissertação é uma análise dos mecanismos protetivos para pessoas transgêneros em privação e liberdade no sistema penal do Rio de Janeiro. Para fazer essa análise, no início do estudo serão enfatizados alguns conceitos-chave relacionados ao movimento LGBT e será demonstrado como esse movimento plural se desenvolveu mundialmente e no Brasil. Então, uma abordagem histórica e criminológica será feita para mostrar como o sistema penal captura seletivamente os desviantes incluindo as sexualidades desviantes , modula subjetividades e propaga estigmas desde sua criação. No final da dissertação, a travestilidade será estudada de acordo com a realidade mostrada pelo Mecanismo Estadual de Prevenção e Combate Contra à Tortura em seu relatório Mulheres e Meninas em Situações de Privação de Liberdade. Além disso, será demonstrado por meio de argumentos críticos e dados organizados como e por que as políticas públicas incluídos os mecanismos de proteção para pessoas transgêneros - são ineficientes na proteção dos direitos humanos.
This thesis is an analysis of the protective mechanisms for transgender people in deprivation of liberty in Rio de Janeiro s penal system. In order to do this analysis, at the beginning of the study some key concepts related to the LGBT will be emphasized and it will be demonstrated how this plural movement developed worldwide and in Brazil. Then, a historical and criminological approach will be made to show that the penal system selectively captures the deviants including the deviant sexualities , modulates subjectivities and propagates stigmas since its creation. At the end of the thesis, the travestility will be studied according to the reality shown by the Estate Mechanism of Prevention and Fight Against Torture in its report Women and Girls in Deprivation of Liberty Situations. Moreover, it will be demonstrated by critical arguments and organized data how and why the public policies - mechanisms of protection for transgender people included - are inefficient in the protection of human rights.
