Esta dissertação pretende analisar as manifestações do trabalho enquanto direito e dever, particularmente do ponto de vista do sistema jurídico brasileiro, inserido, portanto, no sistema capitalista de relações e produção. Os direitos e deveres ao trabalho têm presença estrutural, constante, no modo de viver do homem moderno, particularmente quando o modelo segundo o qual foram estatuídos em sua presente forma passa por nova crise que assinala justamente a não-eternidade do paradigma que se busca compreender. Isto exige um enfoque histórico sobre alguns pontos cruciais do pensamento filosófico, e permite traçar uma relação entre direitos e deveres, liberdade e necessidade, pois afinal é precisamente nisto que a questão do trabalho importa: naquilo que nos exige, e no que nos possibilita. E porque compreender um presente historicizado, cuja origem reside num passado diverso dele, significa vislumbrar também um futuro diverso, e obter, talvez, elementos para atuar na sua criação
This paper intends to investigate the manifestations of work as a right and a duty, specially from the point of view of the brazillian legal system, therefore also as part of the capitalist system of relations and production. The rights and duties to labor have a structural, constant presence in modern man s lifestyle, particularly when the model through which these where stablished in it s present form undergoes a new crisis that marks precisely the non-eternity of the present paradigm, whose understanding is sought. Such a task demands an historical analysis over some of the essential points of philosophy, one that allows us to derive a relation between rights and duties, freedom and necessity, for in the end it is precisely in this that the matter of work is of our concern: in what it demands from us, and in what it allows us. And because understanding an historical present, whose origin resides in a past distinct from it, means to glimpse into na also distinct future, and to acquire, perhaps, means to act on it s creation
