Esther Kulkamp Eyng Prete

Graduated in Law from the Federal University of Paraná (2005). She worked as a lawyer in the area of ​​Tort Law in Brazil, nowadays in Portugal. Master in Philosophy of Law with an emphasis on Science of Legislation (Legística) by the Federal University of Minas Gerais. The research focused on the interface between the quality of the normative set, Economics, New Institutional Economics and concretization of the essential nucleus of fundamental social rights. Currently, a PhD student at UFMG in the same area and with the same thematic focus, now specifically on the essential core of the right to work, contrasting on the one hand the limitation of the formal legal concept "work" (which limits it to the employment relationship), the projections of large-scale transformations in the labor market due to the expected greater penetration of new technologies (digital revolution, automation, artificial intelligence, machine learning, among others) and the barriers imposed by the normative system that keeps a large population of micro-entrepreneurs in a situation of economic exclusion and even poverty. Researcher Associated with the Observatory for the Quality of Law since 2014 and LegisLab - Laboratory of Legislation and Public Policies (linked to the Law course of UFMG). Researches and works focused on the Material Legistics (which focuses on the investigation of the concrete effects of the law on social reality), on the one hand, and its jusphilosophical foundations (Legisprudence, legitimacy of the Modern Law and State, epistemology modernity based on a large-scale historical philosophical prism), on the other. Interests in Legal Economics, Sociology, Philosophy and Epistemology. Themes: the crisis of the Welfare State and the corollary crisis of the Law, social and economic effects arising from the design of the regulatory system, effectiveness of the Law, Normativity, philosophical and historical investigation of the foundations of the Law in Modernity, Legal Ontology.

Possui graduação em Direito pela Universidade Federal do Paraná (2005). Atuou como advogada na área de Responsabilidade Civil em Curitiba (PR), e atualmente radicada em Porto (Portugal). Mestre em Direito pela Universidade Federal de Minas Gerais, em Filosofia do Direito com ênfase em Ciência da Legislação (Legística), cuja pesquisa debruçou-se sobre a interface entre a qualidade do conjunto normativo, Economia, Nova Economia Institucional e concretização do núcleo essencial dos direitos fundamentais sociais. Atualmente, doutoranda pela UFMG na mesma área e com o mesmo enfoque temático, voltado especificamente ao estudo de desafios contemporâneos à promoção do núcleo essencial do direito social e individual ao trabalho, contrastando por um lado a limitação do conceito jurídico formal "trabalho" (que o limita à relação de emprego), as projeções de transformações em larga escala no mercado de trabalho em razão da esperada maior penetração das novas tecnologias (revolução digital, automação, inteligência artificial, machine learning, entre outros) e as barreiras impostas pelo sistema normativo que mantém grande população de microempreendedores em situação de exclusão econômica e até de pobreza. Pesquisadora Associada ao Observatório para Qualidade da Lei desde 2014 e seu LegisLab - Lagoratório de Legislação e Políticas Públicas, vinculados ao curso de Direito da UFMG e coordenados pela Profa. Doutora Fabiana de Menezes Soares. Pesquisas e trabalhos voltados para a vertente da Legística Material (a qual se volta para a investigação dos efeitos concretos da lei na realidade social), por um lado, e dos seus fundamentos jusfilosóficos (Legisprudência, legitimidade da lei e do Estado Modernos, a epistemologia jurídica da Modernidade a partir de um prisma filosófica de larga escala histórica), por outro. Interesses voltados para a Economia, Sociologia, Filosofia e Epistemologia Jurídicas. Temas: a crise do Estado Social e a corolária crise da Lei, efeitos sociais e econômicos oriundos do desenho do sistema regulatório, efetividade do Direito, Normatividade, investigação filosófica e histórica dos fundamentos da Lei na Modernidade, Ontologia Jurídica.
