Sérgio Antônio Silva Guerra

SÉRGIO GUERRA é Visiting Researcher (Yale Law School). Doutor e Mestre em Direito com pós-doutorado em Administração Pública. Diretor e Professor Titular da Escola de Direito do Rio de Janeiro da Fundação Getúlio Vargas - RJ (Graduação, Mestrado e Doutorado). Embaixador no Brasil da Yale University. Editor da Revista de Direito Administrativo - RDA. Em 2018 foi Relator da Comissão de Juristas da Câmara dos Deputados para elaborar propostas de aperfeiçoamento da gestão governamental e do sistema de controle da Administração Pública. Tem experiência de mais de 35 anos, com ênfase em Direito Administrativo, Regulatório e Ambiental, atuando principalmente nos seguintes temas: agências reguladoras, regulação de serviços públicos, PPP infraestrutura e atividades econômicas, discricionariedade administrativa; contratos, arbitragem e controle da administração pública. Autor de diversos livros e artigos jurídicos.

Sérgio Guerra has authored numerous, highly cited studies on regulation and other administrative state related topics. His book, The Theory of Regulatory State, identifies some aspects that converse in the two regulatory systems (US/Brazil), like the stages and which were the reasons that led to the adoption, in the United States, of the model of regulatory intervention in economic and social activities. This analysis focus on identifying the context, the propositions and features of the agency system effectively implemented in Brazil in order to collate the two agency models to check their levels of similarity and to identify which issues and guidelines are relevant to the development of legal research focused on the development of regulatory governance, either by the academic community or by public and private institutions. Sérgio is Dean and Full Professor of Administrative Law at FGV Law School in Rio de Janeiro, Brazil. He is also Legal Advisor for Public Law Commission at Brazilian Bar Association (Rio de Janeiro) and editor of the RDA (Administrative Law Review). He holds J.D., LL.M., and Ph.D. in Law degrees. He has been a postdoctoral fellow at FGV Business Administration School (FGV/EBAPE) and Visiting Researcher at Yale Law School (YLS). Brazil Ambassador at Yale University.
