A presente pesquisa analisa o papel democraticamente exigível dos Tribunais de Contas no exercício da função de controle das políticas públicas metropolitanas de saúde. A partir do pressuposto de legitimidade, investigam-se formas de gestão que derivam do interesse público e vinculam sua eficácia. Tem em vista, assim, o aparente conflito entre a normatização estratificada da Lei Federal n.º 8.080/1990 do Sistema Único de Saúde e a necessidade de tratamento integrado que a complexa seara exige, especialmente após o recente Estatuto da Metrópole a Lei Federal n.º 13.089/2015. Enfrenta-se, assim, o desafio da territorialização das políticas, considerando as competências constitucionais do federalismo tripartite e a difícil conciliação entre orçamento e atendimento das demandas sociais. Para ilustrar as discussões, examinam-se algumas experiências da Região Metropolitana do Rio de Janeiro.
This research analyzes the democratically role required from Courts of Audit in the exercise of the control function of the metropolitan health policies. From the legitimacy of assumption, investigates the forms of management that derive the public interest and link their effectiveness. It aims at, so the apparent conflict between the stratified regulation of the Federal Law n.º 8.080 / 1990 Health System and the need for integrated treatment that it requires, especially after the recent Statute of Metropolis the Federal Law n.º 13,089 / 2015. Facing each other, so the challenge of territorial policies, considering the constitutional powers of the tripartite federalism and the difficult balance between budget and meet the social demands. To illustrate the discussion, examine some experiences in the Metropolitan Region of Rio de Janeiro.
