Esta pesquisa problematiza a pesquisa empírica quantitativa no Direito, particularmente nos seus reflexos no funcionamento da Justiça. No vocabulário de Michel Foucault, problematizar envolve manter uma distância crítica que permita analisar, na sua singularidade histórica, as relações com o verdadeiro/falso de certas práticas. Assim, com esse objetivo de diagnóstico, esta pesquisa busca entender como a Justiça passou a ser avaliada pelos critérios atuais. This research problematizes the Empirical legal studies movement, particularly its reflections on the functioning of Justice. In Michel Foucault's vocabulary, problematizing involves maintaining a critical distance to analyze, in its historical singularity, the relations with the true / false of certain practices.
